Terms & Conditions.

When you sign up to become an instructor on the FDA platform, you agree to abide by these Instructor Terms ("Terms"). These Terms cover details about the aspects of the FDA platform relevant to instructors and are incorporated by reference into our Terms of Use, the general terms that govern your use of our Services. Any capitalized terms that aren't defined in these Terms are defined as specified in the Terms of Use

As an instructor, you are contracting directly with FDA. This is a proprietary firm under the trade name Flagship Design Academy having its registered place of operation at A-208, Himalaya Arcade, Opp. Vastrapur lake, Besides Petrol Pump, Vastrapur, Ahmedabad- 380015, Gujarat, India, regardless of whether another FDA subsidiary facilitates payments to you.

1. Instructor Obligations

As an instructor, you are responsible for all content that you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, communications, assessments, and announcements ("Submitted Content").

You represent and warrant that:

  • you will provide and maintain accurate account information and you are having sufficient knowledge and understanding of the topic you are supporting and guiding to students;
  • you own or have the necessary licenses, rights, consents, permissions, and authority to authorize FDA to use your Submitted Content as specified in these Terms and the Terms of Use;
  • your Submitted Content will not infringe or misappropriate any third party's intellectual property rights;
  • you have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your Submitted Content and use of the Services; and
  • you will ensure a quality of service that corresponds with the standards of your industry and instruction services in general.
  • You will provide your content in the English or Hindi language for easy understanding of students
  • You will inform students in advance about your online availability timings for day
  • You will be assigned one batch of assigned modules with 25 nos. the eligible student of that batch to educate them, guide them throughout the module
  • You will respond back to any student query during your login hours within 10 minutes of time, it may be in the nature of questions, submitted works, correspondence about their queries and knowledge about work performance,
  • You will use the media provided by the FDA for the delivering the education online in the interest of the FDA only as per the terms defined by the FDA time from time and shall install all necessary communication tools and software for seamless provision of service. In case of any difficulties faced you will immediately contact administration head regarding the same.

You warrant that you will not:

  • post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libellous content or information;
  • post or transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, or any other form of solicitation (commercial or otherwise) through the Services or to any user;
  • use the Services for business other than providing tutoring, teaching, and instructional services to students;
  • interfere with or otherwise prevent other instructors from providing their services or content;
  • You will not provide your personal contact details to any student in any form on the online FDA portal;
  • You will not claim any intellectual property right on the information, content and information shared on the platform including any compensation for the same over and above the compensation agreed upon
  • abuse FDA resources, including support services.

2. License to FDA

You grant FDA the rights detailed in the Terms of Use to offer, market, and otherwise exploit your Name and Association with the FDA. This includes the right to add captions or otherwise modify Submitted Content to ensure accessibility.

We may record and use all or any part of your Submitted Content for quality control and for delivering, marketing, promoting, demonstrating, or operating the Services. You grant FDA permission to use your name, likeness, voice, and image in connection with offering, delivering, marketing, promoting, demonstrating, and selling the Services, your Submitted Content, or FDA's content, and you waive any rights of privacy, publicity, or other rights of a similar nature, to the extent permissible under applicable law.

3. Trust & Safety

3.1 Trust & Safety Policies

You agree to abide by FDA's  content quality standards or policies prescribed by FDA from time to time. You should check these policies periodically to ensure that you comply with any updates to them. You understand that your use of the Services is subject to FDA's approval, which we may grant or deny at our sole discretion.

We reserve the right to remove content, suspend pay-outs, and/or ban instructors for any reason at any time, without prior notice, including in cases where:

  • an instructor or content does not comply with our policies or legal terms (including the Terms of Use);
  • content falls below our quality standards or has a negative impact on the student experience;
  • an instructor engages in behaviour that might reflect unfavourably on FDA or bring FDA into public disrepute, contempt, scandal, or ridicule;
  • an instructor engages the services of a marketer or other business partner who violates FDA's policies;
  • an instructor uses the Services in a way that constitutes unfair competition, such as promotion of their off-site business in a way that violates FDA's policies; or
  • as determined by FDA in its sole discretion.

3.2 Relationship to Other Users

Instructors don't have a direct contractual relationship with students, so the only information you'll receive about students is what is provided to you through the Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students on the FDA platform, and that you won't solicit additional personal data or store students' personal data outside the FDA platform. You agree to indemnify FDA against any claims arising from your use of students' personal data.

3.3 Anti-Piracy Efforts

We hereby restrict you to unauthorized use our platform content, media. Material and mechanism offered to students in any form. You agree that FDA will retain the above rights during your tenure of engagement with FDA and 12 months once you leave association with FDA

4. Payments

4.1 Payment Terms

Payment to teachers shall be on monthly basis as per their work performance and agreed terms. It shall be done within 7 working days after end of month unless otherwise agreed in writing.

In order to enable the payment, teacher within 15 Days of joining FDA shall provide their banking details to administration head of FDA.

4.2 Taxes & Deduction

All the payments done to teaches shall be net off applicable taxes, statutory compliances applicable on the monthly payment due as per the prevailing laws and which shall be binding to teachers.

Teachers will provide necessary documents time to time to comply with those laws and deduction under respective laws.

5. Termination of Service

It is hereby confirmed that either party can terminate this agreement by giving 30 days notice, however it must be communicated in writing to the other party. In no case such termination will relieve either party from performing their duties within period of 30 Days. Teachers are not allowed to terminate their terms without completing balance module portion assign to them, similarly FDA can not terminate the agreement if any compensation due to the teacher for the work performed is pending as on date.

However, in non-compliance with any of the terms of this agreement shall amount to termination of service on immediate basis.

6. Deleting Your Account

Instructions on how to delete your instructor account are available on the site We'll use commercially reasonable efforts to make any remaining scheduled payments that are owed to you before deleting your account. You understand that if students have previously enrolled in your Submitted Content, your name and that Submitted Content may remain accessible to those students even after your account is deleted.

7. Miscellaneous Legal Terms

7.1 Updating These Terms

From time to time, we may update these Terms to clarify our practices or to reflect new or different practices (such as when we add new features), and FDA reserves the right in its sole discretion to modify and/or make changes to these Terms at any time. If we make any material change, we will notify you using prominent means such as by email notice sent to the email address specified in your account or by posting a notice through our Services. Modifications will become effective on the day they are posted unless stated otherwise.

Your continued use of our Services after changes become effective shall mean that you accept those changes. Any revised Terms shall supersede all previous Terms.

7.2 Translations

Any version of these Terms in a language other than English is provided for convenience and you understand and agree that the English language will control if there is any conflict.

7.3 Relationship Between Us

You and we agree that no joint venture, partnership, contractor, or agency relationship exists between us. It will be only in the nature of employment.
